MVV refused, application for a new residence permit only from home country?

Hello dear Admins and members,

I have a question for a friend of mine, the ind revoked his residence permit this week after he made an objection and evrything because he and his wife split up and they are on divorce and he has been here for 10 months and his wife is dutch and the questions are.

1 I heard that you can apply for a different residnece permit up to two years after the revoking of your previous residence without going back to your hoem country for a new MVV is that true ?

2 And it gonna work even if he stays illegal here after revoking his residnece if he apply for a new one before the end of the two years the IND will complain and make him a problem because he didnt left the country and then may not accept his application even if he will be fullfil the requirements?

3 he is working now by an uitzendbureau contract is his job will get notified very soon that his residnece permit has been revoked and not valid so they will stop him from working ?

4 he has a new partner now she is dutch as well but she is a student and she works only part time how they can apply for a new residnece permit as unmarried partners (samenwonen) is it possible that they can apply for a residence permit without he go back to his country even she is a student and what are conditions for her as a student ?

Yes, this is true.

He can no longer work, he will lose his job unfortunately.

She has to meet the income requirements. As a student she will probably not meet those right now. She has to earn at least 1684,80 gross per month and needs to have a contract that is still valid for 12 more months after date of application.

So the work gonna get notified fast that his residence permit no lomger valid or there is a chance that he gonna stay working for some time before they know his residence permit is revoked ? And how do they get notified ???

Having money on the bank account only works if the interest she receives meets the income requirement. Since most banks now have negative interest rates, chances that she meets that requirement are next to zero.

Your friend has to inform his employer that his residence permit is revoked. They will eventually get notified.

When he does not have a residence permit he cannot register on an address. He can stay with her illegally, but that can have consequences for her (depending on what kind of house she has). She still has to meet the income requirement when they want to apply.

The only option without such an immediate income requirement is indeed the EU-route.

There is no rule that you have to live together for 6 months for the application for unmarried partners. They have to prove a durable/lasting exclusive love relationship via a lists of questions from the IND, pictures, chats, and other proof that they're in such a relationship. Him having had a relationship before that ended shortly after he came to the Netherlands might very well be taken into consideration, and she still has to meet the income requirement!
